picked thes up form Apisto Dave a couple months ago and was ready to move them into the garage for a nice dark corner and I was surprised by free swimming fry.At first I thought they were shrimp but upon further investigation they are fry.Now its a them and some dwarf pencilfish so planning on keping them in.The father does seem to be mouthing them but is spitting them out is this just him being a good daddy?

If the male is only 'mouthing' the fry and then spitting them out, then this is typical brood behavior. This is usually seen by the female, but 'maternal-oriented' males do this, too - if they have nothing else to occupy their time. How does the female react to the male taking over some of her fry? Usually they aren't too happy.
